Bin Around The Block

We were doing a major house renovation. My wife hired "bin-around-the-block" for the rental of a 40 yd bin to remove the waste. We quickly had a disagreement: the owner/operator of "bin-around-the-block" dropped off a smaller bin. My wife told him to come get his bin as we would have to pay twice to get rid of the material. The owner of "bin-around-the-block" picked up the bin late in the evening - when no one was there - but dumped a bin full of torch-on tar roofing on our property. Very heavy material: this cost us over $800 for its removal. I contacted the RCMP: they in turn contacted the owner of "bin-around-the-block". He admitted dumping the material to the officer, but claimed that it was ours to begin with. Not possible, since the roof of our house was covered with asphalt shingles. The RCMP deemed it "a civil matter" and would not intervene. The owner was listed as living in a gated community: I tried to serve him a Summons to Small Claims Court: the address listed is not even his.
